Blankenship Moves On

In what can only be determined as an astute move, Judge Alan Blankenship has recused himself from all three Stone County cases involving the contentious defendant, Shazer Everquar.

As we reported here, a historic moment occurred in the Stone County Judicial Center on November 24th, 2009.

After having seven days to ponder the implications of that controversial event, on Wednesday December 2nd,  Judge Alan Blankenship recused himself from all cases involving Shazer Everquar, on the basis of avoiding any hint of impropriety.  It was a savvy move, insulating Blankenship from any potential suit being brought against him by Everquar in state court.

Wheels Falling Off

Meanwhile, the wheels may be falling off the wagon for Branson West Prosecutor, Kari Walden and Stone County Prosecutor, Matt Selby.

Blankenship’s likely replacement is none other than Judge Mark Stephens, which does not bode well for the prosecution.  While Stephens is a fine judge, he lacks Blankenship’s experience with criminal cases. Even one ill-timed mistake on the part of Stephens could prove to be disastrous for Walden and Selby.

Two months ago, Mr. Everquar deftly floated a motion for proof of jurisdiction which removed the protection of judicial immunity from the judge.  On November 24th, the defendant began leveraging that point of attack by getting Blankenship to commit to several rulings on the record which later could be used against him in a higher court.  Although he tends to arrive late to the bench, Blankenship wasted no time in accurately sizing up the situation and decided to move on.

The big picture is that Blankenship chose not to jeopardize his promising judicial career over three rather insignificant cases that offer no upside potential.

Defendant’s Powers Have Increased

Nevertheless, before Judge Blankenship left the scene, he bequeathed Mr. Everquar with the status of In Forma Pauperis.  That grants Everquar the ability to command services from the court which normally require payment.  In other words, Mr. Everquar’s ability to conduct investigation on behalf of his cases has expanded under the Blankenship court.

Look for the Branson West prosecutor to try and put that genie back into the bottle by attempting to ram-rod the defendant into court before he has a chance to exercise his new exploratory powers.  Most likely Walden will fail to hoodwink the defendant, but you can be damned sure bet that she’s gonna try.

Selby Walking The Plank

Meanwhile, Matt Selby’s case against Everquar is the grimmest of all.  What was originally almost a slam-dunk has transformed into a walk off the gang plank for Selby.  Thinkmasa.org has uncovered that Stone County Prosecutor Selby is not exactly the bearer of light.  He maintains underhanded affiliations.  Many of his convictions are not on the level and have resulted from railroading innocent white males who were either lied to or caved in to pressure from their own attorneys and took a plea “bargain”.
